Copyright Policy

BPDQ [DEV]'s (also herin "Our Service") policies in accordance with the Digitial Millennium Copyright Act (DMCA) is outlined below, along with our Designated Agent's information and a link to our form. You may submit DMCA notices by email or using our form.
Reporting Copyright Infringement
If you believe that Our Service is being used to host content that infringes a copyright, send notice of that infringement containing the following:
- Name, email, address, phone number of the notifying party
- URLs to the infringing content
- URLs to the original content being infringed
- A statement that the notifying party believes in good faith the material is not authorized by the copyright owner
- A statement made under penalty of perjury that all information in the notic is acurate and that notifying party is authorized to act on behalf of the copyright owner.
- A physical or digital signature of the person authorized to act on behalf of the copyright owner
- An aknowledgement to the notice below that the notifier's information will be forwarded to the alleged infringer giving them an opportunity to respond
Notice: After removing material related to a valid DMCA notice, BPDQ [DEV] will notify the customer responsible for the allegedly infringing material that it has removed or disabled access to the material.
Reserves the right, in its sole discretion, to terminate any User for actual or apparent copyright infringement.
Retracting DMCA Notifications
DMCA notices can be retracted in case a mistake was made and the content is determined to not infringe copyrighted material.
These can be submitted via e-mail to our designated agent below but must contain the following:
- The email must be sent from the original claimaint or an authorized legal representative of the claimaint.
- Links to the infringing content.
- A statement of retraction. "I hereby retract my claims of copyright infringement for the links in this eamil".
- The electronic signature of the claimant, or authorized representative at the bottom of the email. This is a full legal name and cannot be a nickname, company name, DBA, or anything else.
- Email is addressed to our designated agent's email (see below)
- All of this must be included in the body of the same email and not in separate attachments
Submitting Counter-Notification
If your content has a copyright notice and has been removed by Our Service, you can make the case that there has been an error through submitting a counter-notification.
Counter-Notifications are sent by email to our designated agent (see below). They will reach out to the claimant, who will have 10 Days by law to respond. This request for counter notification must:
- Include a statement that you consent to forwarding the information to the claimant.
- Be submitted by the customer who owns the site that is subject to the copyright claim. This is the holder of the account which the site is managed under.
The following information must also be contained in the email body and not as separate emails or attachments:
- Full legal name
- Current physical mailing address
- Current phone number
- Links to the content
- The statement: "I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the judicial district in which BPDQ [DEV] LLC is located, and will accept service of process from the claimant."
- A second statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
- A statement to the claimant that clearly and concisely explains why you believe the remove was a mistake or misidentification of infringement. Include any sources or exceptions your use falls under such as fair use or fair dealing.
- The physical or electronic signature of the submitter of the counter-notification. This is a full legal name, not a company name, and must be at the bottom of the notification.
Repeated Violations
The account holder will have their account terminated and their content permanantely removed after the third active DMCA notification within 90 days. Once the account holder's account is terminated, no refund will be issued.
